MindClick Consulting provides professional certification training and consulting services, including but not limited to:

• Live virtual instructor-led training
• In-person classroom training at our locations in Dubai (UAE), San Francisco (USA), and Bangalore (India)

• Practice exams and assessments
• Study materials and course content
• Consulting and advisory services

3. Registration and Accounts

3.1 Account Creation

To access certain services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Age Requirement

You must be at least 18 years old to register for our services. By registering, you represent that you meet this age requirement.

4. Payment Terms

4.1 Pricing and Currency

All prices are listed in the applicable currency based on your location (USD for US, AED for UAE, INR for India). Prices are subject to change without notice, but changes will not affect orders already placed.

4.2 Payment Methods

We accept major credit cards (Visa, Mastercard, American Express), PayPal, bank transfers, and other payment methods as displayed at checkout. All payments must be received in full before course access is granted.

4.3 Taxes

Prices do not include applicable taxes. You are responsible for all sales, use, VAT, GST, and other taxes associated with your purchase, except for taxes on our net income.

5. Course Enrollment and Access

Upon successful enrollment and payment, you will receive access to course materials, which may include videos, PDFs, slides, practice exams, and other resources. Course materials are for personal use only.

5.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use course materials for your personal educational purposes. You may not reproduce, distribute, modify, or create derivative works from our content.

5.3 Course Completion

Course completion certificates are issued upon successful completion of all course requirements. Certificates are issued in the name registered in your account and cannot be transferred.

PMI®, PMP®, CAPM®, PMI-ACP®, PMBOK®, ITIL®, PRINCE2®, DevOps Foundation®, COBIT®, CSM®, A-CSM®, CSPO®, A-CSPO®, CAL®, and other certification names are registered trademarks of their respective owners. MindClick Consulting is an independent training provider and is not affiliated with, endorsed by, or sponsored by these trademark owners.

8.3 Prohibited Use

You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content for commercial or non-commercial purposes without our express written permission.

9. User Conduct

You agree not to:

• Record, copy, or distribute course materials without permission
• Use the service for any unlawful purpose
• Interfere with or disrupt the service or servers

11.1 No Guarantee of Certification

While we provide comprehensive training, we do not guarantee that you will pass any certification exam. Success depends on your effort, study, and preparation.

11.2 Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

11.3 "As Is" Basis

Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, MindClick Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the services
• Any bugs, viruses, or other harmful code that may be transmitted through our services
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

Our total liability shall not exceed the amount you paid for the specific service giving rise to the claim during the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless MindClick Consulting, its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the services, your violation of these Terms, or your violation of any rights of another party.

14. Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction where the service was purchased:

• United States: State of California, without regard to conflict of law provisions
• UAE: Laws of Dubai International Financial Centre (DIFC)
• India: Laws of Karnataka State and Courts of Bangalore

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the relevant jurisdiction's arbitration authority.

You agree to bring any disputes in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

16. Termination

16.1 By You

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in any conduct that we determine, in our sole discretion, to be inappropriate or harmful to our services, other users, or our business.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement
